Annual Upgrade out of NE2?

my NE2 upgrade date is in March 2010 and my contract expires in July 2010. i really wanted a DROID, so i selected the upgrade option on the site. it said i was unavailable for NE2 pricing (which i knew), but continued the DROID special is $100 online instant rebate anyway, which would be the same as NE2. it offered $199 after rebate for 2 year contract and $269 for 1 year contract. i didn't want to continue my 2 year contracts so i thought the extra $70 was worth it for 1 year. this would extend my contract to November of 2010.

 

my question is this: the verizon rep at the store and people on this board are saying you can't do a 1 year contract upgrade if you are still under contract. my online order has already been processed and the phone is on it's way. does anyone know if my contract will extend to november of 2010 since i specifically selected 1 year and paid the extra $70 or if i will be forced into a 2 year contract?

in case anyone was wondering, it was a scam. they are forcing me into a 2-year contract, even though i paid the $70 extra. i'm trying to get it resolved, but we'll see.

It's not a scam. One of the requirements of using an Annual Upgrade or the NE2 credit is that you sign a TWO YEAR contract. 1 year contracts are not eligible for Annual Upgrade or NE2 pricing. This is a commonly asked question in these forums, do some searching for "annual upgrade" or "new every two" and you'll find posts about these types of transactions. It wasn't a scam. You just didn't read all the terms and conditions.

Seems like the system should prevent users from completing this transaction if they are not elgible.  Terms and conditions or not, he paid the extra money for a service, or rather the privilege of not being locked into a service.  Verizon will not allow this, so he is not getting the privilege he paid for.  He should get a refund for 70 bucks and be re-directed into a two year contract, right?

Yes, the system should prevent that from happening. But sometimes computers are faulty, no? And yes, if that's what happened then he should get a refund of the price difference.

What he paid for was the privilege of upgrading his phone after fulfilling only one year of a two year contract....the "annual upgrade".  Yes, it does extend your contract from two years from the date you make the transaction.  You forego the NE2 upgrade discount by getting a new phone a whole year earlier than you originally agreed to.  And it resets your upgrade clock to two years.  But you have a shiny new phone that you DID get a discounted price on.....
