set box issues with forwarding & being returned to the beginning

I am having an issue with my set box. When I DVR something & fast forward it returns me to the beginning of the show or somewhere in the middle. I have been told this is a "known problem" fix is not until mid or late Feb.. What is my recourse with my contract since I will be without a service that I contracted for, am paying for & was known before I signed up?

Call the billing department. Ask to speak w/a manager or supervisor. See what they can do for you.
Be firm & polite.
